Kathmandu: The candidature of Dr. Toshima Karki, who is a candidate for the House of Representatives in Lalitpur Region No. 3 from the National Independent Party, will not be rejected.
In the case registered by the Election Commission, the Supreme Court gave an order today and said that the candidature of Toshima is still valid.
On Monday, the joint bench of Judges Ishwarprad Khatiwada and Til Prasad Shrestha continued the interim order given earlier by the bench of Judge Kumar Chudal.
After the Election Commission rejected Toshima’s candidacy on the grounds that she was in a position of profit, the bench of Judge Chudal gave an interim order to implement the decision of the commission while hearing the application filed by Toshima.
Secretary of the Election Commission Gokarnamani Dawadi filed a petition in the Supreme Court demanding the cancellation of the interim order. While hearing the petition on Monday, the bench of judges Khatiwada and Shrestha ruled that Toshima cannot be considered to be in a position of profit.
The Election Commission decided that since Toshima is a member of the Nepal Medical Council and she receives meeting allowance from the government fund, her candidature will be rejected by declaring her position as a benefit. Now the commission’s decision will not be implemented and Toshima’s candidacy is still standing.
